Scandals about C-Murder

Miller was found guilty in September 2003 of the January 18, 2002, beating and fatal shooting of a fan, 16-year-old Steve Thomas, at the Platinum Club, a now-closed nightclub in Harvey, Louisiana. Miller was arrested in the early hours of January 19th for causing a disturbance at New Orleans’ House of Blues. On February 28, 2002, he was indicted.

Miller was placed under house arrest while awaiting retrial. On March 13, 2007, Sassone granted Miller’s request to work on his music career on a case-by-case basis, but denied his request for a curfew from 7:00 a.m. to 9:00 p.m.

Sassone’s rulings in the case became an issue in her failed re-election bid in 2008. Judge Ellen Kovach overruled Sassone, and prosecutors renewed their request to have Miller returned to jail. Miller was placed under house arrest in January 2009 and could only leave for a documented medical emergency.

Miller pleaded no contest to two counts of attempted second-degree murder on May 27, 2009. These charges stem from a 2001 incident in Baton Rouge in which Miller fired one shot from a semi-automatic pistol, which jammed, at the owner and bouncer of a nightclub who refused to allow Miller to enter the establishment with the gun.

The murder trial began on August 5, 2009. The victim’s father stated that his son was a fan of C-Murder prior to the incident. The jury reported being deadlocked on August 10, 2009, but Judge Hans Liljeberg directed them to try to resolve the deadlock. Three hours later, the jury returned to announce a guilty verdict of 10–2.

Given the earlier announced deadlock followed by the quick reversal, the judge suspected that one of the jurors decided to switch under pressure to end the trial and instructed the jury to return and deliberate on the case longer.

C-Murder was sentenced to life in prison by District Judge Hans Liljeberg on August 14. Ernest Johnson, president of the Louisiana NAACP, requested an investigation into the jury deliberations on August 27, 2009.

As a result, Miller filed an appeal against his conviction. The Supreme Court then denied Miller’s final appeal on February 19, 2013. Miller’s attorneys argued that because federal juries must reach unanimous verdicts in criminal cases, Miller should not have been convicted in Louisiana after a jury voted 10–2.

Miller’s attorney, Rachel Conner, filed a post-conviction relief application in Gretna state court on April 2, 2014. She raised ten points to support her claim that her client did not receive a fair trial. Conner stated that she intends to raise more points.

On June 26, 2018, Kenneth Jordan, a key witness in Miller’s 2009 trial, recanted his testimony, claiming that detectives forced him to testify against Miller or face a 10-year prison sentence for unrelated criminal charges. On July 6, another witness, Darnell Jordan, recanted his testimony, claiming that police had detained and locked him in a hotel room for refusing to testify against Miller.
