McGinley was the son of Irish immigrants Bob and Emily McGinley, and was born in Newport Beach, California. He attended USC on a water polo scholarship after graduation, concentrating in urban planning and real estate.

He dropped out of USC after his scholarship was not renewed, and relocated to New York in 1979.

After seeing him with his nephew from the Cunninghams, a filmmaker discovered a character he had portrayed from 1980 to 1984. In 1982, he landed a role in the comedy film Young Doctors in Love, which he appeared in during his Happy Days. He played Stanley Gable, the head of the jock-run Alpha Beta fraternity and the primary antagonist of the Lambda Lambda Lambda nerd fraternity, in Revenge of the Nerds, which he reprised in the third and fourth movies in the “Nerds” franchise, both produced for television, after Happy Days ended in 1984.

He later went on to have recurring roles on television shows such as The Love Boat and Dynasty. From 1991 through 1997, he played Al Bundy’s best buddy Jefferson D’Arcy on Married… with Children, which he described as a “wonderful, great gig.” He has recurring roles as Dana’s boyfriend Gordon on Aaron Sorkin’s television series Sports Night and as a television news man on The West Wing. He then went on to play Charley Shanowski on Hope & Faith from 2003 to 2006.

After a two-year wait, he was chosen for a role in Charlie Lawrence, a situation comedy starring Nathan Lane as a freshman congressman from New Mexico. Graydon Ford, Lane’s title character’s neighbor and a member of the opposition political party, was played by him.

He also appeared as a senator in the pilot episode of the 2002 CBS sitcom Life of the Party.
